Terms and Conditions

Welcome to the Everymat website terms and conditions of use. Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions.

We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.

The terms 'Everymat', 'us', 'we', and 'everymat.com' refers to the owner of the website whose address is PO Box 18697, Peterhead, AB42 9AQ.  The term 'you' refers to the user or viewer of this website.

Registered Users

1. In order to access the services provided on this website, you must become a registered user.  You must complete registration by providing certain information as set out on our registration page. Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide on registration.
2. You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
3. On registration, we provide you with a password and User Name. On registration you agree to pay for our services as set out on our website.
4. You must be responsible to keep your User ID and password secure, and be responsible for all transactions made by users you have authorized to use your User ID and password.
5. We reserve the right to terminate your registration at any time if you breach these terms and conditions.

Our Website Services

6. All prices are in Great British Pounds (GBP) and are exclusive of VAT until this is shown at check-out stage. We endeavour to ensure any price list issued are current.  Our prices can be accessed from our home page and we reserve the right to amend our prices at any time. If you have placed an order, we reserve the right to cancel your order should our prices change.

Product Descriptions

7. We strive to ensure that our website is as accurate as possible but make no warranty, express or implied, as to the nature or accuracy of any material detailed and therefore cannot accept liability.  Any reliance you place on any information is therefore strictly at your own risk.  We reserve the right to change any specifications , prices or pictures at any time.  Where we become aware of any misdescription, we reserve the right to correct any error or omission. 
8. Due to the nature of the product there will be a manufacturing size tolerance of which details can be requested from our technical advice team.  When measuring for specific areas please bear these specific tolerances in mind.
9. Images such as in-situation photographs, product images, or material swatches are intended to serve as a guide only.  These have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product, as colours vary between computer/ monitor settings and production batches.  Where accuracy is essential we always recommend you refer to a fabric swatch, available on request.

Product Orders

10. We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website.
11. Packaging and postage may be an additional charge, please ensure you are aware of charges that will be applied for delivery before you place an order with Everymat.
12. VAT is not included on product prices shown and is applied at the check-out stage on all goods assessable for VAT.
13. When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.
14. We undertake to accept or reject your order within 7 days. If we have not responded to you within 7 days, your offer is deemed to be rejected. We are not required to give reasons for rejecting your offer to purchase however the most likely reason for rejecting your offer will be that we do not currently have that product in stock.
15. Delivery of your ordered product/s will be as set out on our website. Title in the goods passes to you when we have received payment, or when goods are delivered, which ever situation occurs first.
16. All risk of loss or damage to the goods passes to you once goods are delivered.
17. It is the responsibility of the person ordering to obtain authorization to use copyrighted or trademarked designs on any printed mat products.  Any licensing fees are the responsibility of the person placing the order.
18. Persons ordering from Everymat and through this site must be over the age of 18 years.

Delivery of Goods

19. It is our company commitment to despatch goods on the same day as an order is received depending on the time your order was received.  We use a range of professional courier services which operate a Nextday service to most UK mainland addresses, although should you select our standard delivery service, or any other delivery service available at the check-out stage then your goods may not be received the following day, although we will select the most efficient delivery method available for this service.
20. Goods will be dispatched to the address provided by yourselves on your order.  Signatures for deliveries are required and must be made by persons over the age of 18 years.  Should you experience a delay with delivery, or if an expected delivery has not arrived, then please contact us at sales@everymat.com or use our track an delivery from via the website, and we will track and trace your delivery as quickly as possible.

Product Returns for Companies

20. In the unfortunate situation you receive an item from us that you are unsatisfied with or believe that an item is missing from your delivery, please report this to our Customer Services team within 3 working days of receiving goods for faulty items and for short delivery.  In this situation we would usually issue a credit or replace the item immediately.
21. Please be aware that short delivery can be tracked through individual parcel weights for each shipment and fraudulent claims would be recorded and responded to in a legally acceptable manner.
22. Claims for damages required photographic evidence to be sent by e-mail to admin@everymat.com.  This allows us to underpin any issues within our manufacturing and warehouse departments.  Claims made without photographic evidence, particularly after 14 days, unfortunately cannot be accepted.
23. When goods are despatched correctly as per your order and in the expected condition, but are not what you expected, these goods can still be returned.  It is your own responsibility to return goods within 5 working days from date they were received, to the correct returns address, in packaging and protection originally provided by Everymat, and should they be received by Everymat in a suitable saleable condition then we will issue a credit to the original sale value less a 20% handling and re-stocking charge.  Carriage charged for carriage on the original delivery by Everymat and the cost incurred for returning the goods will not be reimbursed.
24. There are some products that cannot be returned for refund, such as personalised products, customised mats such as specials sizes and cut lengths, and specially sourced products that we have specifically sourced as per your request, as these may not re-saleable through our website.

Product Returns for Consumers

26. Under the Consumer Contracts Regulations 2013, consumers (not companies) within the UK and EU have a legal right to cancel an order with 14 days following receipt of the goods.   Refunds for orders cancelled under the provisions of the Consumer Contracts Regulations 2013 will be processed in accordance with your legal rights.  If you wish to cancel a product or service you have ordered from us, please be aware the following terms will apply;

  • Applicability of cancellation rights:  The right to make a return does not apply to certain products and services such as specially customized items including printed products and made to measure products.
  • Damaged or incorrect goods:  All products should be checked against your order and should products have been short delivered or damaged, we must be informed by phone, e-mail or post within 3 working days of receiving the goods and goods must be returned to the correct returns address as soon as possible and within 14 workings days of informing us that the products are damaged or have been incorrectly supplied.
  • Damage to goods during return transit:  Should you return goods to us, we will not be responsible for any loss or damage to them in transit and for this reason we recommend a recorded delivery service is used.  If returned goods are lost or damaged in transit we reserve the right to charge for these goods, or not to refund any amounts attributed to the goods for such loss or damage.
  • Cancellation of order:  If you wish to cancel an order for goods that were delivered in a suitable condition and as per your original order, then you must inform us within 14 days following the date of receiptYou must take reasonable care of the products that you wish to cancel and not use them at all.  Products should be promptly returned in their original packaging at your own cost.  We recommended you use a recorded delivery method and we reserve the right to charge a 20% handling and re-stocking fee.

27. Should a return be completed and is viable under the Consumer Contracts Regulations 2013, then a full refund of the goods will be issued for a cancelled order, or a replacement product will be issued for faulty or damaged goods.  We reserve the right to withhold payment for goods damaged on return, and do not refund carriage charges incurred for cancelled orders.

Site Access

28. When you visit our website, we give you a limited licence to access and use our information for personal use.
29. You are permitted to download a copy of the information on this website to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other way infringes our intellectual property rights.
30. Except as permitted under the Copyright, Designs and Patents Act 1988, you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior written permission.
31. The licence to access and use the information on our website does not include the right to use any data mining robots or other extraction tools. The licence also does not permit you to metatag or mirror our website without our prior written permission. We reserve the right to serve you with notice if we become aware of your metatag or mirroring of our website.

Intellectual Property Rights

33. The copyright to all content on this website including applets, graphics, images, layouts and text belongs to Everymat,or we have a licence to use those materials.  All rights reserved.
34. All trademarks, brands and logos generally identified either with the symbols TM or ® which are used on this website are either owned by us or we have a licence to use them. Your access to our website does not license you to use those marks in any commercial way without our prior written permission.
35. Content from this site may not be distributed, exploited commercially, transmitted or stored in other websites or electronic retrieval systems, without the written prior permission of Everymat.

Disclaimers

36. Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.
37. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.
38. We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

Limitation of Liability

39. To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again.
40. We accept no liability for any loss whatsoever including consequential loss, personal injury, damage to property, or loss of profits, suffered by you arising from product/s we have supplied.
41. We are not responsible for placement of floor mats after delivery and it is your own responsibility to ensure the selected product is suitable for the intended purpose.   It is recommended you ensure product specification will meet your requirements before ordering from Everymat.

Indemnity

42. By accessing our website, you agree that you shall be liable for any costs, claims, legal fees incurred by us, and arising as a result of breach of these terms and conditions, also to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

Force Majeure

43. Force Majeure means any act, circumstance or omission over which we could not reasonably have exercised control.  This would include, but is not restricted to, adverse weather conditions, fire, flood, explosions, accidents, acts of terrorism, vandalism, governmental act, riot, war, act of God, or industrial dispute, and we shall not be liable for any breach of obligation or for compensation or refund for loss, damage or delay resulting from an event of Force Majeure.
44. If a Force Majeure event causing delay continues for more than thirty days we are entitled to terminate any agreements and shall not have any liability in respect of the termination caused by the event.  We will endeavor to make our customers aware of any event of Force Majeure giving details of the circumstances and as much notice as possible with a reasonable estimate of when this is likely to cease.

Governing Law and Jurisdiction

45. These terms and conditions are to be governed by and construed in accordance with the laws of England and Wales and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts.
46. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Security and Virus Protection

47. Data transmissions over the internet cannot be guaranteed as totally secure.  We endeavour to protect such information, but we do not warrant and cannot ensure the security of any information which you transmit to us and such transmissions are entirely at your own risk.  We are not liable for any damages or loss arising out of or resulting from any unauthorized access to, alteration to or modification of information contained on this website.
48. This website has been checked and tested at production stage for faulty processes, but you must take your own precautions to ensure that the process you use for accessing this website doe not expose you to risk of viruses, malicisious computer code, or other forms of interference which may damage your own computer system.  We recommend you run a anti-virus program on anything you download from the internet, including documents provided on this website.

Privacy 

49. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
